Όροι συνεργασίας
Παρακάτω καθορίζονται οι όροι της διμερούς συνεργασίας μεταξύ:
Αφενός, της διαδικτυακής πλατφόρμας SeaExcursions.gr και αφετέρου του εκάστοτε συνεργάτη/διοργανωτή που προσφέρει προϊόντα προς πώληση στην SeaExcursions.
H SeaExcursions είναι μία διαδικτυακή πλατφόρμα προώθησης και πώλησης ποιοτικών προϊόντων θαλάσσιου τουρισμού και δραστηριοτήτων νερού. Ως τέτοια, η SeaExcursions αναλαμβάνει τη συνεχή ανάπτυξη και διαφήμιση του ιστοτόπου και των συμπεριλαμβανομένων σε αυτόν προϊόντων, με στόχο την εξασφάλιση πελατών που αναζητούν θαλάσσιες εμπειρίες και άλλες υπαίθριες δραστηριότητες που αφορούν το υδάτινο στοιχείο σε όλη την Ελλάδα. Η SeaExcursions, μέσω της συνεργασίας της με το διαχειριστικό πρόγραμμα κρατήσεων Kleesto, προσφέρει σε όλους τους διοργανωτές δωρεάν πρόσβαση στο πρόγραμμα αυτό με προσωπικό κωδικό, δίνοντας τη δυνατότητα ανεξάρτητης και ασφαλούς διαχείρισης των προϊόντων και της διαθεσιμότητάς τους.
Οι συνεργαζόμενοι με τη SeaExcursion επιχειρηματίες, διοργανώνουν εκδρομές και υπηρεσίες σε θάλασσα και νερό, υπηρετώντας τις προϋποθέσεις ποιότητας που θέτει η πλατφόρμα και εκτελώντας τις υπηρεσίες αυτές με απολύτως νόμιμο τρόπο. Τα προϊόντα που προωθούνται μέσω της SeaExcursions θα πρέπει να διοργανώνονται από τον εκάστοτε συνεργάτη, και όχι να αποτελούν προϊόντα μεταπώλησης από αυτόν.
Ασφάλεια
Ο εκάστοτε διοργανωτής οφείλει να έχει ασφαλίσει το σκάφος/όχημα και κάθε μέσο που χρησιμοποιεί για την μεταφορά και εξυπηρέτηση των πελατών.Οφείλει να έχει εφοδιασμένο το σκάφος/όχημα με όλα τα νόμιμα έγγραφα, σύμφωνα με τις ισχύουσες για αυτό διατάξεις της νομοθεσίας, να συμμορφώνεται προς τους ισχύοντες νόμους, διατάγματα, υπουργικές αποφάσεις και αστυνομικές διατάξεις, καθώς είναι υπεύθυνος για κάθε παράβαση του έναντι του νόμου, των επιβατών, των τρίτων.
Η SeaExcursions δε φέρει ουδεμία ευθύνη σε περίπτωση που ένας διοργανωτής αποδειχθεί ότι δεν εκτελεί νομίμως την προσφερόμενη υπηρεσία ή δραστηριότητα.
Παροχή υπηρεσιών
Ο διοργανωτής υποχρεούται να εξασφαλίσει στους πελάτες όλες τις υπηρεσίες και αγαθά όπως ακριβώς αυτά αναγράφονται στην περιγραφή του προϊόντος που έχει αναρτηθεί στον ιστότοπο SeaExcursions.gr. O διοργανωτής οφείλει να ελέγξει την ακρίβεια της περιγραφής των προϊόντων του στο SeaExcursions.gr. Mεταξύ άλλων, οφείλει να πληροί όλες τις νόμιμες προϋποθέσεις και όρους υγιεινής, καθαριότητας και εξυπηρέτησης, καθώς επίσης και να εξασφαλίσει ότι τηρούνται όλες οι νομοθετικές διατάξεις περί καπνίσματος.
Ευθύνη
Σε περίπτωση που -λόγω της μη εκπλήρωσης ή της πλημμελούς εκπλήρωσης εκ μέρους του διοργανωτή, των υποχρεώσεων που αναλαμβάνει με το παρόν ή/και άλλων που προβλέπονται από τον Νόμο- η SeaExcursions υποχρεωθεί να αποζημιώσει τον πελάτη, το ποσό της αποζημίωσης θα αφαιρεθεί αυτόματα από το προς εκκαθάριση σύνολo και ο διοργανωτής θα χρεωθεί επιπλέον 20% προμήθεια επί της αρχικής τιμής πώλησης.
Πολιτική ακύρωσης
Σε περίπτωση ακύρωσης ταξιδιού από τον διοργανωτή λόγω αδυναμίας εκτέλεσης αυτού, προκύπτουσας από γεγονός ανωτέρας βίας (συμπερ. ακατάλληλων καιρικών συνθηκών), ο διοργανωτής οφείλει να ενημερώσει εγκαίρως τόσο τους πελάτες όσο και την SeaExcursions και να προτείνει εναλλακτική ημέρα/ώρα τέλεσης της υπηρεσίας. Σε περίπτωση αδυναμίας αναπλήρωσης της υπηρεσίας, η SeaExcursions θα αποζημιώνει τον πελάτη για το σύνολο του ποσού που έχει καταβληθεί, και το ποσό αυτό θα αφαιρείται αυτόματα από το προς εκκαθάριση σύνολο.
Σε περίπτωση ακύρωσης ταξιδιού από τον πελάτη, ισχύουν οι πολιτικές ακύρωσης όπως αυτές έχουν συμφωνηθεί μεταξύ της SeaExcursions και του διοργανωτή, και έχουν κοινοποιηθεί σε κάθε προϊόν αναρτημένο στον ιστότοπο SeaExcursions.gr υπό μορφή FAQ. Το ποσό της αποζημίωσης θα αφαιρείται αυτόματα από το προς εκκαθάριση σύνολo.
Τιμολόγηση
Η SeaExcursions θα κρατά ποσοστό 20% ως προμήθεια επί του τελικού ποσού της κάθε κράτησης.
Η SeaExcursions θα εκδίδει παραστατικό στους πελάτες για το σύνολο του πληρωτέου ποσού.
Με την ολοκλήρωση της κράτησης, ο διοργανωτής της εκδρομής/πάροχος της υπηρεσίας θα εκδίδει προς την SeaExcursions τιμολόγιο με ξεκάθαρη χρέωση για το 80% του συνολικού ποσού της κράτησης, το οποίο θα εξοφλείται άμεσα.
Cooperation conditions
We hereby determine the terms of bilateral cooperation between:
On one side, the SeaExcursions.gr web platform and on the other side the partner/Organizer who offers products for sale to SeaExcursions.
SeaExcursions is an online platform for the promotion and sale of quality sea tourism products and water activities. As such, SeaExcursions undertakes the continuous development and advertising of the website and all included products, with the aim of acquiring customers interested in marine experiences and other outdoor activities related to the water element throughout Greece. SeaExcursions, through its cooperation with the booking management system “Kleesto”, offers all Organizers free access to this system with their own personal code, allowing independent and safe management of their products and availability.
The partners of SeaExcursion are businesses that organize excursions and services at sea and water, within the quality requirements set by the platform, and performing these services in a completely legal way. SeaExcursions seeks direct partnerships and thus, products promoted through SeaExcursions should be organized and conducted by the partner, rather than being resale products.
Security
The vessel/vehicle and any means of transport and customer service should be insured by the Organizer. The vessel/vehicle must be equipped with all legal documents in accordance with the provisions of the applicable laws, and should comply with the applicable laws, decrees, ministerial decisions and police regulations, as the Organizer is solely responsible for any violation of the law, passengers and third parties.
SeaExcursions shall have no liability in the event that an Organizer proves not to be legally executing the service or activity offered.
Provision of services
The Organizer is obliged to assure all services and goods as they are listed in the product description posted on the SeaExcursions website. The Organizer has to verify the accuracy of the description of his products in SeaExcursions.gr. Among other things, all services and goods provided must meet all legal requirements and conditions of hygiene, cleanliness and service, as well as ensure that all legal provisions on smoking are complied with.
Responsibility
In the event that -due to the non-fulfillment or defective fulfillment by the Organizer of the obligations undertaken and/or other provisions of the Law- SeaExcursions is obliged to compensate the customer, the amount of compensation will automatically be deducted from the total to be settled and the Organizer will be charged an additional 20% commission on the initial sale price.
Cancellation Policy
In case of cancellation of a trip/service by the Organizer due to failure to perform it, resulting from a force majeure event (including unsuitable weather conditions), the Organizer must inform customers as well as SeaExcursions in a timely manner and propose an alternative day/time of service. In case of failure of the Organizer to replenish the service, SeaExcursions will reimburse the customer for the full amount paid, and this amount will automatically be deducted from the total to be settled.
In case of cancellation of a trip by the customer, specific cancellation policies apply, as these are agreed between SeaExcursions and the Organizer, and have been published to each product’s display on SeaExcursions.gr in FAQ format. The amount of compensation will be automatically deducted from the total to be settled.
Pricing
SeaExcursions will keep a 20% commission on the final amount of each booking.
SeaExcursions will issue a voucher to customers for the full amount payable.
Upon completion of the reservation, the Organizer will issue to SeaExcursions an invoice with a clear charge for the 80% of the total amount of the reservation, which will be paid by SeaExcursions immediately.
